A dramatic weekend in US politics has seen the Supreme Court strike down President Trump’s sweeping “Liberty Day” tariffs, followed swiftly by the announcement of a new 15% tariff on global imports, this is what we know so far.
What Did The Supreme Court Rule?
In a 6–3 decision on Friday, Supreme Court justices upheld a federal court ruling to block the Liberty Day tariffs. The Court found that the President had unlawfully used the International Emergency Economic Powers Act (IEEPA), stating that the circumstances did not justify such extensive economic action. The judgment represents a significant curb on presidential trade authority.
How Did Trump React?
President Trump reacted angrily, criticising the justices, including some he appointed, as an “embarrassment to their families”. He labelled the decision flawed, unfair and anti-American. In response, he invoked Section 122 of the Trade Act of 1974, announcing a 10% global tariff.
What Is Section 122?
Section 122 allows a president to impose a temporary surcharge of up to 15% on imports for 150 days in the event of “large and serious” balance-of-payments problems. Any extension beyond that period requires approval from Congress.
Will The New Rate Be Extended?
That decision rests with Congress, which may have little appetite to prolong the measure. Earlier this month, the House of Representatives voted 219–211 against punitive tariffs on Canada.
Have All Trump Tariffs Become Void?
No. Tariffs introduced under separate legal authorities including those on steel, aluminium and automotives remain in force.
What’s Happening About Refunds?
The Court did not address refunds, potentially worth between $130 and $175 billion. With no automatic repayment scheme in place, more than 1,000 firms have filed lawsuits, which could prove lengthy. Trump himself has said the refund process will be long and contested and may drag on for years.
How Will The UK Be Affected?
The UK’s position seems to be unchanged. US Trade Representative Jamieson Greer said that the US will continue to honour tariff agreements it has already finalised with a number of countries around the world, including the UK.
